NJ Prevailing Wage Data Centers

Infographic showing the NJ Prevailing Wage Data Center Law 2026 update, comparing old public funding rules to new private project thresholds of 250kW at a New Jersey construction site.
The "Old Rule" is officially dead. As of April 1, 2026, private data center projects in NJ are no longer exempt from prevailing wage. If your build hits 250kW capacity or 5MW annual usage, the NJDOL is watching. Are you ready for the 2026 compliance shift?

The "Old" Rule:  No public money = No prevailing wage.

The 2026 Rule:  If it’s a Data Center over 250kW, it is a Prevailing Wage job. Period.

On January 20, 2026, New Jersey changed the game. Whether the money is private or public, your data center project likely just fell under N.J.S.A. 34:11-56.25 (The NJ Prevailing Wage Act). NJ Prevailing Wage Data Centers

Does This Apply to My Job?

Starting April 1, 2026, if you are working on a Data Center, check these two numbers. If you hit EITHER, you are in:

  • 250 Kilowatts (kW) or more of electrical capacity.

  • 5 Megawatts (MW) or more of annual usage.

The Reality Check: Almost any modern, professional-grade NJ data center build hits these numbers. If you’re on the crew, you’re likely now a Prevailing Wage contractor.

The 3 Biggest Risks to Your Bottom Line

1. Joint & Several Liability (The "Sub" Trap)

If your subcontractor misses a payment or messes up their fringes, the State comes after YOU (the GC) for the cash. Under the 2026 law, you are now 100% legally and financially responsible for their mistakes.

2. Certified Payroll is Mandatory

You can't just cut a check. You need NJDOL-approved certified payroll reports submitted weekly via the NJ Wage Hub. One missed filing can lead to immediate stop-work orders and heavy administrative fines.

3. Registration & OSHA

Every sub must be registered with the NJDOL (PWCR) before they step on site. Supervisors need OSHA-30; everyone else needs OSHA-10. No exceptions.

Frequently Asked Questions (FAQ)

Q: Does this apply to renovations or only new builds?

A: It applies to "construction, reconstruction, demolition, alteration, or repair work." If you are upgrading the cooling or power systems of an existing data center over 250kW, the law applies.

Q: What happens if I miss a certified payroll filing?

A: The NJDOL can issue immediate stop-work orders and penalties of up to $2,500 for a first violation, plus potential debarment.

Q: Can I use my standard commercial payroll software?

A: Most standard platforms (like ADP or Quickbooks) do not automatically track NJ county-specific fringe benefits or generate the specific electronic files required by the NJ Wage Hub.

  • Subcontractor Guardrails: Our system helps you track sub-compliance so you don’t get hit with their liability.
